Terms of Service

1. Acceptance and scope

By accessing or using our Services, creating an account, publishing a Deal or Brag Offer, participating as a Bragger, or purchasing a subscription, you agree to these Terms and any additional terms shown at checkout or inside a specific Offer. If you use the Services for a business, you represent that you are authorized to act for that business.

If you do not agree, do not use the Services.

2. What the Services do

BragAbout helps businesses create referral offers that people can share. SaleScroller helps shoppers discover current Deals from participating businesses. The Big Dealio may bundle these tools under one subscription and account experience.

We provide platform and tracking tools. We are not the seller of a participating business's goods or services and are not a party to the underlying transaction between a shopper and a business.

3. Accounts and accurate information

You are responsible for keeping account credentials secure and for information submitted through your account. Business owners must keep business names, contact information, Deals, Offer terms, prices, availability, deadlines, locations, and fulfillment details accurate and current.

You may not impersonate another person or business, create deceptive accounts, or use the Services for unlawful activity.

4. Deals and Brag Offers

Businesses are solely responsible for the Deals and Brag Offers they publish and for honoring valid terms made available to shoppers or Braggers. Material limits, expiration dates, qualification requirements, redemption rules, reward amounts, and other conditions should be stated clearly.

We may format, categorize, pause, remove, or refuse content that is misleading, unlawful, abusive, duplicative, technically harmful, or inconsistent with the purpose of the Services.

5. Referrals, Braggers, and rewards

Businesses may create Brag Offers describing what counts as a qualifying referral and what reward is available. Offer-specific terms control qualification. Businesses, not BragAbout, are responsible for validating qualifying referrals and paying rewards owed to Braggers.

BragAbout may track statuses such as Submitted, Accepted, Pending Qualification, Qualified, Payment Due, Payment Sent, and Payment Received, but does not hold reward funds in escrow and does not guarantee payment by a participating business.

6. Prohibited conduct

• Fraudulent, fabricated, or manipulated referrals, reservations, reviews, clicks, accounts, or transactions.
• False advertising, impersonation, deceptive pricing, bait-and-switch practices, or misleading availability claims.
• Spam, harassment, malware, attempts to bypass access controls, or interference with other users.
• Content that infringes intellectual-property, privacy, publicity, or other rights.
• Use of the Services to promote illegal goods, services, or conduct.

7. Your content and our license

You retain ownership of content you submit. You give us a non-exclusive, worldwide license to host, reproduce, format, display, distribute, and technically adapt that content as needed to operate, promote, and improve the Services, including Deals, business profiles, Brag Offers, images, and shareables.

You represent that you have the rights needed to provide that content and grant this license.

8. Subscriptions and billing

Paid subscriptions renew automatically according to the billing interval and price shown at checkout until canceled. Trials, promotions, cancellations, failed payments, plan changes, and refunds are governed by our Subscription, Cancellation & Refund Policy and any terms shown at checkout.

9. Third-party services

The Services may rely on third parties such as Stripe for payment processing and billing management, hosting providers, email providers, analytics services, and other infrastructure. Your use of those services may also be subject to their terms and privacy practices.

10. Suspension and termination

We may suspend or terminate access when reasonably necessary to address fraud, abuse, security risk, nonpayment, legal requirements, or material violations of these Terms. Obligations that arose before suspension or termination remain in effect, including valid customer commitments and Bragger rewards that were already earned or became payable.

11. Service availability and disclaimers

We work to keep the Services useful and available, but do not guarantee uninterrupted operation, a particular number of shoppers, referrals, leads, sales, earnings, search placement, or business results. Marketplace rankings, feeds, search results, and visibility may change over time.

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis without warranties not expressly stated in writing.

12. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost business opportunities, or losses arising from a participating business's goods, services, Deal fulfillment, referral payment, or conduct. Any liability that cannot lawfully be excluded is limited to the amount you paid us for the Services during the twelve months preceding the event giving rise to the claim.

13. Indemnity

To the extent permitted by law, business users agree to defend and indemnify us from third-party claims arising from their business content, Deals, Offer terms, goods or services, violations of law, or breach of these Terms.

14. Changes and contact

We may update these Terms as the Services evolve. We will post the revised version with a new effective date and provide additional notice when required by law. Questions may be sent to contact@bragabout.net.
